As above, when it turns on your router requests its maximum speed, which it then limits itself to. There's no real easy way to push new speeds out.

so in theory you could edit your modem to remove the cap?

Yes it can be done, yes it breaks ToS, yes your ISP will find out, no you shouldn't do it.
