Genocide is defined as:

"The systematic and planned extermination of an entire national, racial, political, or ethnic group."

If the charge is pertaining to the war itself, and the Germans have deemed it illegal (how they can apply that kind of process to their own law I have no idea), then it is possible to charge someone directly affiliated with genocide. At least by a long shot in saying that "political" group.
