By contracting their diaphragm and thus having their rib cage move up and out, causing a change in the pressure of their lungs, particles move to balance the pressure and thus air moves in to their lungs (relaxing the diaphragm is how to breathe out, by the way)
Supporters of Proposition 8 will argue California does not discriminate against gays, as the current law allows them to get married - as long as they wed a partner of the opposite sex.
