No, I don't agree. I admit that one COULD consider him a cheater, but I don't think one should. If you use a loose definition of the term, then you can consider him a cheater, but if you use common sense, you know that his usage doesn't make him a cheater. His mentality is not that of a cheater.
If you want to play semantics, then go ahead, but the rest of us will use common sense and not consider Spoony a cheater.
