I would like to make a legal pursuit against Jonathan D. Holmes for using private work of my mod and posting it on the internet.

How should I start this ?

He is making fun of something I didn't released for good reasons...

I took a screenshot of the page, and recorded the source so I have proof. Now I want to go further and have him to the court.

I never gave my permission to JD holmes to use or download any of my work. He has to pay.


They used a hack on phpbb ( 2.0.13 needed or you will be hacked too ) to gain access to internal board, thx god they think we use only that place and so found only old files it seems...)

If it can be done, Renardin will do it, If ACK was able to take action against Joey for the URL hijack, I think something can be done against him for that act of slander. I mean the the skin was still WIP, hence it wasn't released to the public.

Legal action? Laughing Good luck. You put your work in a public directory where one of my forum members found all of your artwork assets. I simply posted one of the most horrible pieces of shit you made up for everyone to see, and now you cry foul?

There's no legal basis for any claim you could make with this. Joey was infringing on our intellectual copyright by violating the standards set forth for registering domain names. Since we're not taking your domain name after it expires, there's absolutely nothing you can do except pull your head out of your collective asses and learn how to put your files in a secure location where someone like fatcat can't just waltz in; he downloaded whatever he wanted because not only was the folder unprotected, the files weren't either.

Lol, you can't, he hasn't done anything illegal. Firstly, he didn't get it from the server, Fatcat did, they both said that he did a couple times in that thread. He isn't using your private work. And posting your texture on the internet isn't illegal.

Even what Fatcat did wasn't illegal, he didn't break into it and steal it since it's a public folder (not passworded), anyone could have.

Besides it being Aircraftkiller and that he posted your texture, why is this such a big deal? It's completely worthless without the model the UVW mapping was made for.

Before you complain about me posting a single craptacular texture you made, rememeber you've actually violated international law several times by taking my portraits and editing them. As far as I can remember, with my memory being as unreliable as it is at 7:30 AM, you've made about six edited versions of my portraits... All done without my consent, and all done in an attempt to harass and defame my person.

That violates Internet harassment laws, if you didn't realize it before. Be sure to mention that part to your uncle, and especially to the police, right before they laugh at you for wasting their time.

If he actually uses it on any of his work, then yes: perhaps you'd have some legal recourse. However, posting a picture of it on a website does not constutiute "use".

Making a vehicle, putting it on, then distributing it... that would be "use"

If it indeed was a secure place, then perhaps you have some recourse against them for that action.

Edit: quick reminder... Lawsuits cost money, lots of money. So if you are willing to spend the required funds to attempt a lawsuit, then thats your prerogative.

Not only that, the only "evidence" you have is a recording and a picture. The court won't take that too seriously because of programs like Adobe Photoshop, if you know what I mean. Even though you didn't doctor anything, you'd still need more proof.

Also, if someone doesn't have their files stored in a secure place, then that's not an excuse to steal them. The fact is, is that the file was still on his server, so taking the file from it and publicly using it could be illegal, regardless if it was not securely stored.
